Filing Requirements

Power of attorney, simply signed. A separate power is required for each application.

Copy of priority document, if priority is claimed.

12 prints of the mark for each application..

Items 1 and 3 must be submitted at the time of filing. Document 2 may be submitted within 3 months from filing date.

Trademark registration procedure:

The registration procedure lasts 6 months from filing to registration.. The opposition period doesn’t exist. The protection lasts 10 years from the application date.
Trademark renewal: The renewal application within 6 months before expiry. For the renewal we need simply signed power of attorney
Trademark changes: For changing the name or the address we need a simply signed power of attorney duly The certificate of change the name, with verified French translation.
Trademark assignments: For the assignment, a simply signed power of attorney and the deed of assignment translation with apostile.
Trademark use: When a registered mark has not been continuously used for the goods or services concerned for 5 years preceding the request for cancellation (for 5 years from the date of the last use), a cancellation action may be filed by an interested person.

Time Frame: The global approximate time frame for all the above actions is one month, whether it is a first registration , or a renewal or a change of identity or address, or an assignment,

 
 

Industrial Designs
A single industrial design application may contain up to 100 models or designs, as long as these are intended to be incorporated in objects grouped in the same class of the Locarno classification system.

Industrial designs will be registered for an initial period of 5 years from the filing date, which term will be renewable for a further two consecutive periods of 5 years upon the payment of renewal fees. There is a grace period of six months.

Design protection in Djibouti is available via a national filing. Djibouti design law makes provision for the claiming of an earlier priority date provided the application is filed within 6 months of the first claim to priority.

The requirements:

Power of Attorney (simply signed) – required on the day of filing;
Formal drawings – required on the day of filing;
Assignment of Design (simply signed), if applicable – required on the day of filing; and
Certified copy of Priority document with verified English translation, if applicable – required on the day of filing.

Implementation of regulation has not yet been issued
