Iraq-Baghdad Adopts the 11th edition of the Nice Classification

The Trademark Office in Iraq-Baghdad has announced its adoption of the 11th edition of the Nice Classification. This significant step brings Iraq into alignment with international standards and supersedes the previously utilized 7th edition, known for its sub-classes classification system.

While the exact implementation date for the 11th edition has not been explicitly specified by the Trademark Office, its adoption is imminent, while we are of the view that it will be put into effect in January 2025.

A notable consequence of this transition is the reclassification of services previously registered under class 42. The impact on existing registrations remains uncertain at this time and it is unclear whether these registrations will be automatically reclassified to classes 43 to 45 or at the time of any post-registration actions once the new classification is adopted or if additional individual actions will be required from trademark owners.

Additionally, it is anticipated that the current practice of sub-classes listing classification headings alphabetically may be discontinued with the implementation of the 11th edition. However, official confirmation regarding this change is still awaited.

Iran Enacts New Intellectual Property Law and Fee Increase

As of October 22nd, 2024, a new Iranian IP Law along has come into effect which has introduced newly increased official fees for several Trademark, Patents and industrial design services.

Saudi Arabia:  SAIP to Become International Searching Authority (ISA) and International Preliminary Examining Authority (IPEA)

 In its PCT Newsletter No. 10/2024 of October 2024, the WIPO has circulated that the Saudi Authority for Intellectual Property (SAIP) is set to assume its new role as an International Searching Authority (ISA) and International Preliminary Examining Authority (IPEA) under the Patent Cooperation Treaty (PCT), effective December 15, 2024. This appointment, conferred upon SAIP by the PCT Assembly in July 2023, marks a pivotal moment in the organization history and the Kingdom intellectual property landscape.

Implications:

The appointment of the Saudi Authority for Intellectual Property (SAIP) as an International Searching Authority (ISA) offers several advantages such as:

  • SAIP, being a Saudi Arabian authority, will be well-equipped to provide patent search and examination services in Arabic.
  • Applicants filing PCT applications from Arabic-speaking countries, can designate SAIP as the ISA.
  • SAIP role as an ISA can contribute to a stronger intellectual property ecosystem in the region, providing better protection for innovations.
  • This, in turn, can stimulate innovation and economic growth in Arabic-speaking countries.
